1. Access
1.1 By accessing and using this website, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using this website, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. All such guidelines or rules are hereby incorporated by reference into the Terms & Condition.
1.2 By entering and using this website you certify the below statements are true:

• I agree that any products purchased from theoarn will be used for lawful purposes.
• Use of any of our products is entirely at the risk and discretion of the user and Theoarn.com will not be responsible for any use or misuse of the products sold herein.
• Our company attempts to be as accurate as possible. However, our company does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Our Company itself is not as described, your sole remedy is to return it in unused condition.
2. Our rights
We reserve the right to:
2.1 Modify or withdraw, temporarily or permanently, this site (or any part thereof) with or without notice to you.
2.2 Restrict your access to the site or part of it. If we grant you access to a restricted part of the site we may withdraw permission at any time.
2.3 Make changes to our Conditions from time to time. We will notify you of these changes of use by posting the revised versions of these Conditions on the site. You can determine when we last changed these Conditions by the ‘Last updated’ statement above.
2.4 Protect our Intellectual Property rights in the Site, including all of the text, pictures, videos and other content made available on the site. You acknowledge and agree that:
2.4.1 All Copy Right, Trademarks and all other Intellectual Property rights which form part of the website shall remain at all times our property.
2.4.2 All material contained on this website is only available for your personal use, excluding commercial use.
2.4.3 You agree not to copy, reproduce, transmit, publish, display, distribute, commercially exploit or create any part of our website, including all intellectual property rights unless expressly preauthorised and permitted by us.
2.5 If you in any way, whatsoever, breach clause 2.4 we reserve the right to claim damages against you, for your breach of our intellectual property rights and demand that you stop using the content taken from our site immediately.
3. Use
Your permission to use the site is personal to you and non-transferable, and you may not use the site for commercial purposes, unless our written permission is given. Your use of the site is conditional upon the rules set out in these Conditions and you agree that you will not:
3.1 Use the site for any fraudulent or unlawful purpose;
3.2 Use the site to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others, including without limitation others privacy rights or rights of publicity;
3.3. Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the site;
3.4 Interfere with or disrupt the operation of the site or the servers or networks used to make the site available;
3.5 Transmit or otherwise make available in connection with the site any virus, worm, Trojan horse or other computer code that is harmful or invasive or may or is intended to damage the operation of, or to monitor the use of, any hardware, software of equipment;
3.6 Remove any copyright, trade mark, or other propriety rights notices from the site or materials originating from the site;
3.7 Frame or mirror any part of the site without our express prior written consent;
3.8 Reproduce the presentation of the site.
4. Price
4.1 Prices are as displayed based on currency and location. Currency is picked up by the IP address on a customer’s first visit to the site. You can change your country via the country selector in our footer.
4.2 Prices displayed exclude delivery charges where applicable. Please see the Shipping Policy section below for details on tax and duties inclusion.
4.3 Please note we accept HKD dollars, US dollars, Euros, British Pounds, Japanese Yen and Australian Dollars. Your shipping country may determine which currency you can shop in.
5. Returns and Cancellations
5.1 Please read our return policy carefully to ensure you can proceed with your request as quickly as possible.
5.2 All returns should be sent back to us in their original packaging provided. Please ensure when returning the parcel that the THEOARN box is adequately protected.
5.3 You have 30 days from receipt of order to request your return, confirmation of your return will be emailed to you. Unsuitable items must then be returned within 30 days of receiving your returns confirmation. Returns outside this window may be accepted at our discretion. The item(s) should be returned unused and in perfect condition, with all THEOARN and brand tags still in place. Returns that are damaged, used or returned without their original labels may not be accepted and may be sent back to the customer.
5.4 To ensure your return is covered by our free returns policy and does not encounter a delay, items must be returned using the original packaging provided including the original inner box and from the same country to which they were delivered. Items returned from a different country may incur additional charges or be delayed by customs. You can return using any secure means but we may not accept liability.
5.5 Before your parcel leaves our warehouse, it is fully checked and controlled by our packing team. If you receive an item which is damaged, please contact us immediately.
5.6. If your item is faulty (i.e. received damaged or with a manufacturing fault), we can offer alternatives such as repair or exchanges. For more information, please contact our client service team.
5.7 If we notice that you have a high returns rate on your account, then we may take the decision to deactivate your account until we can understand a little more about what’s not quite working for you. We will contact you via email if we deem this an appropriate course of action – our client service team will help to resolve the issue with you.
5.8 All successfully returned items will be only credited to the account used originally to purchase the items, less any taxes, import duties or original shipping charges incurred and will be refunded in the currency in which you paid at the price you paid at the exchange rate prevailing on the day when you bought the item. 5.9 Please note, Important Shipping Policy Update：
We regret to inform you that, due to international legal and policy restrictions, we are currently unable to process or ship orders from the following countries: Ukraine, Cuba, Yemen, Iran, Congo (Brazzaville), South Sudan, Afghanistan, Russia, Libya, Burundi, North Korea, Venezuela, Somalia, Sudan, Myanmar, Syria, Iraq, Belarus, Congo (Kinshasa).
These restrictions are due to international sanctions, legal requirements, and logistical difficulties in these regions. We sincerely apologize for the inconvenience. For questions or further support, please reach out to our customer service team.
5.10 Our returns policy does not affect your statutory rights in any way.
6. Payment
6.1 Your credit/debit card will be debited following control and verification of the details and the validity of the card. The amount to be debited shall be available and will be withheld upon confirmation of your order by the Company.
6.2 In addition to the price of the ordered products, you will be required to pay any courier charges associated with shipping the products. Each time you submit an order, you agree to pay any such additional charges in advance. To complete a purchase through the website, you must follow the instructions therein. The order form requires you to enter your debit/credit card number and expiration date. As the beneficiary of the debit/credit card, you are fully responsible for the accuracy and correctness of this information.
6.3 Pay With Credit/Debit Card
We accept Visa, MasterCard. Please note that THEOARN does not collect your credit/debit card number or personal information when you make a payment. For questions regarding your transactions on our site, please consult your card-issuing bank for information.
7. Security of Payments/Transactions
7.1 For safety reasons, our Company does not save the details of any debit/credit card for future use and therefore you will have to re-enter the card details every time you make a new purchase. Upon filling in the details of your debit/credit card as requested by the Terms of the website, you explicitly and unconditionally state that you have the legal right to use this debit/credit card.
7.2 The Company bears no liability in case of unlawful use of debit/credit cards.
7.3 Upon providing the details of your debit/credit card, you explicitly and unconditionally state that you agree with charging your card with the total amount of the purchase you make on the website, including every possible added cost. In case the transaction with your debit/credit card is rejected by the issuing bank or the network of the debit/credit card for any reason (indicatively for exceeding the credit limit or suspicion of fraud), then the purchase will not be completed. In such case, instead of the usual email for confirming your order, you will receive an email from the Company stating that the transaction was not completed successfully due to reasons relevant to the methods of payment.
8. Optional Tools
8.1 We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
8.2 You acknowledge and agree that we provide access to such tools on an “as is” and “as available” basis without any warranties, representations or conditions of any kind and without liability of any kind. We shall not be liable for any liability arising from or relating to your use of optional third-party tools.
8.3 Any use of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider.
